New article about damages for properties' loss of value due to the erection of wind turbines

The latest issue of International Law Office (ILO) contains an article by Partner Søren Stenderup Jensen and Attorney Peter Holm Larsen about damages for adjoining properties' loss of value due to the erection of wind turbines. In a number of decisions the Appraisal Authority has awarded damages in accordance with the Danish Promotion of Renewable Energy Act. However, in general the awarded damages have been relatively far from the individual neighbours' assessments or expectations to the extent of the loss. As a result, local authorities often hesitate before granting permission for the erection of wind turbines.
