Brexit and the challenges of the UK joining the UPC

On 23 June 2016, the UK voted to leave the EU. On 28 November 2016, the UK surprisingly announced that it would ratify the Unified Patent Court Agreement. Sture Rygaard, Attorney and Plesner Partner, and Peter Nørgaard, Attorney, write about Brexit and the challenges of the UK joining the UPC in the new edition of the Danish trade paper Dansk Biotek.

It is possible that the new patent court can see the light of day as early as 2017 or at the beginning of 2018. The UK's participation in the UPC, despite the decision to leave the EU, causes some uncertainty that may affect the UPC and consequently everyone holding a European patent or a European patent application. The questions caused by the UK leaving the UK may affect everyone using the UPC regardless of the patent being in force in the UK.
