Non-traditional trademarks - registration of the first Danish motion mark
In the new Danish Trademarks Act, which entered into force on 1 January 2019, it is no longer a requirement for the registration of a trademark that it can be depicted graphically. Accordingly, it is now possible to register more of the so-called non-traditional trademarks.
As the first in Denmark, the Danish Resuscitation Council has successfully registered a short video sequence as a "motion mark".
The Danish Patent and Trademark Office accepts the following 10 types of trademarks:
Word marks; figurative marks; shape marks; position marks; pattern marks; colour marks; sound marks; motion marks; multimedia marks and hologram marks.
Any company using or planning to use non-traditional trademarks should consider applying for a Danish trademark with the Patent and Trademark Office or an EU trademark with the European Union Intellectual Property Office.
