Since it was established in the 1940s Plesner's Tax Law team has been market-leading when it comes to litigation. We conduct the biggest and most complex cases; starting with the first proceedings involving the Danish tax authorities to the Danish National Tax Tribunal then the courts and the Court of Justice of the European Union, if necessary.

Our track record is unique. No other Danish law firm has been as successful as Plesner in so many important tax cases. Many of the cases are test cases and subsequently result in the reopening of corresponding cases as well as statutory amendments or changes in administrative practice. Through the years Plesner has greatly influenced legislative developments.

In September 2023 the tax publication International Tax Review has named Plesner "Denmark Tax Firm of the Year". Plesner has been named "Denmark Tax Firm of the Year" twelve times since 2009. 

Our method - quality of the highest standard

In complex tax cases decisive arguments do not grow on trees. To us, tax litigation is a creative process in which it is necessary to think differently. The solution is often found in similar disputes in other legal fields. Tax litigation therefore also requires a great deal of knowledge about legal fields other than tax law. We focus on the details but keep a broad perspective.

Advisory services are a matter of trust. We speak our minds. We take nothing for granted and review all relevant issues, and we challenge conventional ways of thinking.

A number of strategic choices must continuously be made in any tax case. The right advice about each choice can be crucial for the final outcome of the case.

  • Foundation - successful in appeal proceedings before the National Tax Tribunal reversing the Danish Tax Agency's case law in respect of additional taxation of the tied-up funds of foundations on dissolution. The Danish Tax Agency subsequently issued guidelines on the possibility of extraordinary reopening of proceedings due to the reversal of case law
  • NetApp - this is the only case in the Danish Beneficial Owner group of cases in which the Danish Supreme Court has found in favour of the tax payer and held that there was no abuse and, hence, no obligation to withhold tax at source (in relation to one out of two dividend distributions) 
  • Viking Life-Saving Equipment A/S - successful before the City Court in Esbjerg (3 judges) in a claim that the company's TP documentation was not deficient and that the Danish Tax Agency had therefore not been entitled to assess the income on a discretionary basis. Following the company's presentation of evidence, the court found that the company had established that the company's lower margins on sales to subsidiaries compared to sales to buyers outside the group were based on commercial considerations. The Ministry of Taxation has appealed the ruling to the Western High Court as a second instance
  • Codan Forsikring - successful before the Danish Eastern High Court in a claim that expenses relating to reinsurance agreements entered into between Codan Forsikring and an intra-group company could be deducted as operating costs, and that the agreements had moreover been entered into at arm's length. Consequently, the tax authorities’ increase of Codan’s Forsikring's income was set aside 
  • International group in the energy sector - successful administrative appeal before the National Tax Tribunal in a claim that a transfer of an intra-group receivable was not taxable under the capital gains tax regime or the transfer pricing rules 
  • Global service provider - case essentially won in first Danish case decided by Advisory Commission (arbitration tribunal) under the EU Arbitration Convention 
  • Shareholder - successful before the Court in Lyngby in a claim that the deduction of a share loss of DKK 60m could not be refused on grounds of circumvention/abuse
  • GF Forsikring (GF Insurance Group) - successful before the Eastern High Court in a landmark case concerning the understanding and application of the general EU anti-abuse principle in respect of a VAT set-up
  • Danish distribution group - successful before the Danish National Tax Tribunal in a case confirming the group's transfer pricing method and reducing the Danish Tax Agency's income adjustments 
  • The Greenlandic Code - successful before the Danish Supreme Court in a claim that the municipality administration duty for commercial waste was wrongfully charged 
  • Shareholder - in a case before the City Court of Copenhagen the Danish Ministry of Taxation acknowledged and admitted wrongful taxation of a shareholder loan 
  • ECCO - successful before the Danish Western High Court in a claim that ECCO Sko A/S had acted at arm's length when trading with intra-group production companies and that the tax authorities' transfer pricing increase of ECCO Sko A/S's income was therefore unfounded

  • Majority shareholder - successful before the Danish Western High Court in a claim that the allocation of the taxable value of a forest property in an assessment notice could form the basis of an assessment of the taxable value of having access to a summer residence
  • Global industrial group - successful before the Danish National Tax Tribunal in a claim that  the Danish Tax Agency's transfer pricing increase with respect to the transfer of intangible assets should be set aside. As a result, the increase was reduced by approximately DKK 3.8bn 
  • Private business owner - successful before the Danish Western High Court in a claim that debt cancellation agreements do not per se result in deficit limitation for the debtor at the time  of signing
  • The Phoenix-group - successful before the Danish Eastern High Court that cross-border intra-group mergers have retroactive effect for tax purposes to the accounting date of the merger
  • Masco Denmark/Damixa - successful before the Court of Justice of the European Union in a case of general public importance about whether Danish tax law on taxation of intra-group interest  is in conflict with the Treaty on European Union

  • Spar Nord Bank A/S (formerly Sparbank A/S) - successful before the Danish Western High Court in that the bank's discretionary allocation of payroll costs on taxable and non-taxable activities based on the breakdown of turnover under section 38 of the Danish VAT Act could not be set aside as the Danish Customs and Tax Administration had not proved that the Administration's estimate was more correct than the bank's
  • VAT carousel fraud - the Supreme Court found in favour of the defendant in an action for damages of general public importance instituted by the Danish Ministry of Taxation against the management of a company that had been used by a trusted employee for participation in fraud-related trading
  • Seven upper secondary schools in the City of Aarhus -  successful before the Danish Western High Court in that service charges cannot be levied on properties owned by upper secondary schools

  • Danish Insurance Association (DIA) acting for Taksatorringen - successful before the Danish Supreme Court in that Taksatorringen, which makes vehicle damage assessments on behalf of its members, was not to pay VAT on its services
  • Nordania Finans A/S - successful before the Court of Justice of the European Union and the Danish Supreme Court in that a leasing company could include the turnover from the sales of leased assets after the termination of the leasing agreements when calculating the pro rata VAT deduction

  • Codan - successful before the Danish Eastern High Court in that the insurers were not liable to pay tax on a salary cut agreed with Codan in return for the cover of a number of business costs. It meant that there was no duty to deduct tax
