Reintroduction of Bill to amend the Danish Public Procurement Act

On 7 October 2015 the Danish Minister for Business and Growth reintroduced a Bill to amend the Danish Public Procurement Act that was scheduled to enter into force on 1 January 2016. For the next couple of months Plesner will follow the events closely.


The Bill, which is based on the new Public Procurement Directive (Directive 2014/24/EU) and the report by the Danish Committee on Procurement Law from December 2014, entails a number of amendments and clarifications compared to the present state of the law, including in respect of the following subjects:
  • Public procurement comprised by the scope of the Public Procurement Directive
  • Public procurement not comprised by the scope of the Public Procurement Directive
  • Awarding contracts in-house
  • Selection and exclusion
  • Awarding contracts, including extensive regulation of the use of evaluation models and point models
  • Amendments to and termination of contracts
The Bill to amend the Danish Public Procurement Act was originally tabled in March 2015 by the former Government. Directive 2014/24/EU must be implemented into Danish law on 18 April 2016 at the latest.
