New state aid register

From 1 July 2016 Danish authorities must register state aid of more than EUR 500,000 in a public web-based state aid register. The purpose is to increase transparency in respect of state aid of a certain value. 

In recent years the European Commission has thoroughly revised the EU's state aid rules. This revision has, among other things, resulted in the Member States' obligation to establish and operate a national and public web-based register in which aid of more than EUR 500,000 must be registered and be publicly available. The purpose is to increase transparency in respect of state aid of a certain value.

The authority paying the aid is responsible for making the registration. The registration deadline is no later than six months after the grant of the aid, meaning as a rule the time at which an authority has made a commitment to a business to grant the aid.

The requirement to make registrations in the state aid register does not change the obligation to notify state aid grants to the European Commission and await the Commission's approval before the aid can be granted to the businesses, if such approval is required, nor the obligation to inform the Commission about the application of the general block exemption no later than 20 days after the aid has been granted. It will be possible for the authority in question to gather a large part of the information to be provided in connection with the registration in the state aid register from the Commission's web-based notification system (SANI).
