Unilever obtains injunction against the D'or tex detergent

Assisted by Plesner, Unilever N.V. and Unilever Danmark A/S (Unilever) have obtained an injunction against Coop Danmark A/S and Nopa Nordic A/S marketing and selling the D'or tex detergent.

The Danish Eastern High Court found that it had been proved that the packaging for the D'or tex detergent infringed Unilever A/S's rights to the Bio-tex packaging under sections 1 and 18 of the Danish Marketing Practices Act.

This case is particularly relevant because Plesner obtained two market surveys that were produced before the Danish Eastern High Court and they seem to have been decisive to the Court granting the injunction.

No security was demanded as the Danish Eastern High Court found that the infringement had been proved. The Danish Eastern High Court consequently reversed the Danish Mari-time and Commercial High Court's decision not to grant an injunction as that Court had not found that the infringement had been rendered probable.
