Full-service consultant is successful

In a ruling of 15 February 2016 an arbitration tribunal found for a full-service consultant in a case involving a significant claim for fees and dismissed that the full-service consultant's conduct had been actionable in other respects.

In the period from 2009 to 2014 the last part of the ring road system in the Municipality of Odense had been planned and completed in the form of Odin's Bridge and Odin's Bridge alone had a total budget of approximately DKK 400,000,000.

Odin's Bridge is a double swing bridge with two bridge sections being able to turn sideways when ships pass on Odense Canal. Each of the bridge spans is almost 100 metres long, and with four lanes and a two-way cycle lane the width is 28 metres. Each span weighs almost 2,000 tonnes.

Plesner's client, ISC Rådgivende Ingeniører A/S, was the full-service consultant on the project and in 2013 the company received "Den Danske Konstruktionspris" (a Danish construction award) for Odin's Bridge which is the longest double swing bridge in Europe.

The arbitration tribunal awarded ISC Rådgivende Ingeniører A/S a significant additional fee and the arbitration tribunal dismissed all claims raised by the Municipality of Odense against ISC Rådgivende Ingeniører, including in relation to claims raised by a number of contractors against the Municipality of Odense.
