Ørsted is again acquitted of the Danish competition authorities' claim of abuse

The claims against Elsam (now Ørsted) of alleged excessive pricing and abuse of a dominant position in Western Denmark have now been completely dismissed. Accordingly, the cases between Elsam and the Danish competition authorities have been concluded. Plesner represented Elsam.

On 24 May 2018, the High Court of Western Denmark dismissed the Danish competition authorities’ claim that Elsam (now Ørsted) had abused a dominant position in the wholesale market for physical electricity in Western Denmark by charging excessive prices during the period 1 January 2005 - 30 June 2006.

In the light of the judgment, the parties have now agreed to dismiss the claim that Elsam allegedly charged excessive prices and thus abused a dominant position in Western Denmark during the second half of 2003 and throughout 2004.

This marks the final conclusion of the cases between Elsam and the Danish competition authorities.
